General Concepts and Scope of Application<\/strong><\/h3>\n\n\n\n<p>1.1. Definitions:<\/p>\n\n\n\n<p><strong>Personal Data Database<\/strong> &#8211; a named set of ordered personal data in electronic form and\/or in the form of personal data card files.<\/p>\n\n\n\n<p><strong>Responsible Person<\/strong> &#8211; a designated person who organizes work related to the protection of personal data during their processing in accordance with the law.<\/p>\n\n\n\n<p><strong>Owner of the Personal Data Database<\/strong> &#8211; a natural or legal person who is granted the right to process these data by law or with the consent of the data subject, who determines the purpose of processing personal data in this database, establishes the composition of these data, and procedures for their processing unless otherwise provided by law.<\/p>\n\n\n\n<p><strong>State Register of Personal Data Databases<\/strong> &#8211; a unified state information system for the collection, accumulation, and processing of information about registered personal data databases.<\/p>\n\n\n\n<p><strong>Public Sources of Personal Data<\/strong> &#8211; directories, address books, registers, lists, catalogs, other systematized collections of open information containing personal data placed and published with the knowledge of the data subject. Social networks and internet resources where the data subject leaves their personal data are not considered public sources of personal data (except when the data subject explicitly states that the personal data are placed for the purpose of free distribution and use).<\/p>\n\n\n\n<p><strong>Consent of the Data Subject<\/strong> &#8211; any documented voluntary expression of will by a natural person regarding the granting of permission to process their personal data in accordance with the stated purpose of their processing.<\/p>\n\n\n\n<p><strong>Depersonalization of Personal Data<\/strong> &#8211; removal of information that allows identifying a person.<\/p>\n\n\n\n<p><strong>Processing of Personal Data<\/strong> &#8211; any action or set of actions carried out fully or partially in an information (automated) system and\/or in personal data card files related to the collection, registration, accumulation, storage, adaptation, modification, updating, use, and dissemination (distribution, sale, transfer), depersonalization, destruction of information about a natural person.<\/p>\n\n\n\n<p><strong>Personal Data<\/strong> &#8211; information or a set of information about a natural person who is identified or can be specifically identified.<\/p>\n\n\n\n<p><strong>Manager of the Personal Data Database<\/strong> &#8211; a natural or legal person who is granted the right to process these data by the owner of the personal data database or by law. A person who is instructed by the owner and\/or manager of the personal data database to perform technical work with the personal data database without access to the content of personal data is not considered a manager of the personal data database.<\/p>\n\n\n\n<p><strong>Data Subject<\/strong> &#8211; a natural person concerning whom the processing of their personal data is carried out in accordance with the law.<\/p>\n\n\n\n<p><strong>Third Party<\/strong> &#8211; any person other than the data subject, owner, or manager of the personal data database and the authorized state body for the protection of personal data, to whom the owner or manager of the personal data database transfers personal data in accordance with the law.<\/p>\n\n\n\n<p><strong>Special Categories of Data<\/strong> &#8211; personal data about racial or ethnic origin, political, religious, or ideological beliefs, membership in political parties and trade unions, and data concerning health or sex life.<\/p>\n\n\n\n<p>1.2. This provision is mandatory for application by the responsible person and the employees of the seller who directly process and\/or have access to personal data in connection with their job duties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. List of Personal Data Databases<\/strong><\/h3>\n\n\n\n<p>2.1. The seller is the owner of the following personal data databases:<\/p>\n\n\n\n<ul>\n<li>Personal data database of contractors.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. Purpose of Personal Data Processing<\/strong><\/h3>\n\n\n\n<p>3.1. The purpose of personal data processing in the system is to ensure the implementation of civil-law relations, provision, receipt, and performance of calculations for purchased goods and services in accordance with the Tax Code of Ukraine, the Law of Ukraine &#8220;On Accounting and Financial Reporting in Ukraine&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. Procedure for Processing Personal Data: Obtaining Consent, Notification of Rights, and Actions with Personal Data of the Data Subject<\/strong><\/h3>\n\n\n\n<p>4.1. The consent of the data subject must be a voluntary expression of will by a natural person regarding the granting of permission to process their personal data in accordance with the stated purpose of their processing.<\/p>\n\n\n\n<p>4.2. The consent of the data subject can be provided in the following forms:<\/p>\n\n\n\n<ul>\n<li>A paper document with requisites that allow identifying this document and the natural person.<\/li>\n\n\n\n<li>An electronic document that contains the mandatory requisites allowing identifying this document and the natural person. It is advisable to certify the voluntary expression of will by a natural person regarding the granting of permission to process their personal data with an electronic signature of the data subject.<\/li>\n\n\n\n<li>A mark on the electronic page of the document or in the electronic file being processed in the information system based on documented software and technical solutions.<\/li>\n<\/ul>\n\n\n\n<p>4.3. The consent of the data subject is provided during the arrangement of civil-law relations in accordance with current legislation.<\/p>\n\n\n\n<p>4.4. Notification of the data subject about the inclusion of their personal data in the personal data database, rights defined by the Law of Ukraine &#8220;On Personal Data Protection&#8221;, the purpose of data collection, and persons to whom their personal data are transferred is carried out during the arrangement of civil-law relations in accordance with current legislation.<\/p>\n\n\n\n<p>4.5. The processing of personal data about racial or ethnic origin, political, religious, or ideological beliefs, membership in political parties and trade unions, and data concerning health or sex life (special categories of data) is prohibited.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. Location of the Personal Data Database<\/strong><\/h3>\n\n\n\n<p>5.1. The personal data databases specified in section 2 of this provision are located at the address of the seller.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6. Conditions for Disclosure of Information about Personal Data to Third Parties<\/strong><\/h3>\n\n\n\n<p>6.1. The procedure for accessing personal data by third parties is determined by the conditions of the consent of the data subject given to the owner of personal data for the processing of these data or in accordance with legal requirements.<\/p>\n\n\n\n<p>6.2. Access to personal data is not granted to a third party if the specified person refuses to assume obligations to ensure the fulfillment of the requirements of the Law of Ukraine &#8220;On Personal Data Protection&#8221; or is unable to ensure them.<\/p>\n\n\n\n<p>6.3. A subject of relations related to personal data submits a request for access (hereinafter &#8211; the request) to personal data to the owner of the personal data database.<\/p>\n\n\n\n<p>6.4. The request specifies:<\/p>\n\n\n\n<ul>\n<li>Surname, first name, and patronymic, place of residence (location), and details of the document identifying the physical person submitting the request (for a physical person &#8211; applicant).<\/li>\n\n\n\n<li>Name, location of the legal entity submitting the request, position, surname, first name, and patronymic of the person certifying the request; confirmation that the content of the request corresponds to the authority of the legal entity (for a legal entity &#8211; applicant).<\/li>\n\n\n\n<li>Surname, first name, and patronymic, as well as other information allowing identifying the physical person concerning whom the request is made.<\/li>\n\n\n\n<li>Information about the personal data database concerning which the request is submitted or information about the owner or manager of this personal data database.<\/li>\n\n\n\n<li>List of requested personal data.<\/li>\n\n\n\n<li>Purpose and\/or legal grounds for the request.<\/li>\n<\/ul>\n\n\n\n<p>6.5. The period for reviewing the request for its satisfaction cannot exceed ten working days from the date of its receipt. Within this period, the owner of the personal data database informs the person submitting the request that the request will be satisfied or the relevant personal data cannot be provided, indicating the basis determined by the relevant regulatory legal act. The request is satisfied within thirty calendar days from the date of its receipt unless otherwise provided by law.<\/p>\n\n\n\n<p>6.6. Deferral of access to personal data of third parties is allowed if the necessary data cannot be provided within thirty calendar days from the date of receipt of the request. In this case, the total period for resolving the issues raised in the request cannot exceed forty-five calendar days.<\/p>\n\n\n\n<p>6.7. Notification of the deferral is communicated to the third party who submitted the request in writing, explaining the procedure for appealing such a decision.<\/p>\n\n\n\n<p>6.8. The notification of deferral specifies:<\/p>\n\n\n\n<ul>\n<li>Surname, first name, and patronymic of the official.<\/li>\n\n\n\n<li>Date of sending the notification.<\/li>\n\n\n\n<li>Reason for deferral.<\/li>\n\n\n\n<li>Period during which the request will be satisfied.<\/li>\n<\/ul>\n\n\n\n<p>6.9. Refusal of access to personal data is allowed if access to them is prohibited by law.<\/p>\n\n\n\n<p>6.10. The notification of refusal specifies:<\/p>\n\n\n\n<ul>\n<li>Surname, first name, and patronymic of the official refusing access.<\/li>\n\n\n\n<li>Date of sending the notification.<\/li>\n\n\n\n<li>Reason for refusal.<\/li>\n<\/ul>\n\n\n\n<p>6.11. The decision to defer or refuse access to personal data can be appealed to the court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong><strong>7. Protection of Personal Data: Protection Methods, Responsible Person, Employees Directly Involved in Processing and\/or Having Access to Personal Data in Connection with Their Job Duties, Retention Period of Personal Data<\/strong><\/strong><\/strong><\/h3>\n\n\n\n<p>7.1. The owner of the personal data database is equipped with system and software and technical means and communication means that prevent losses, theft, unauthorized destruction, distortion, forgery, copying of information and meet the requirements of international and national standards.<\/p>\n\n\n\n<p>7.2. The responsible person organizes work related to the protection of personal data during their processing in accordance with the law. The responsible person is determined by the order of the owner of the personal data database. The responsibilities of the responsible person regarding the organization of work related to the protection of personal data during their processing are specified in the job description.<\/p>\n\n\n\n<p>7.3. The responsible person must:<\/p>\n\n\n\n<ul>\n<li>Know the legislation of Ukraine in the field of personal data protection.<\/li>\n\n\n\n<li>Develop procedures for access to personal data of employees in accordance with their professional or official or job duties.<\/li>\n\n\n\n<li>Ensure that the employees of the owner of the personal data database comply with the requirements of Ukrainian legislation in the field of personal data protection and internal documents regulating the activities of the owner of the personal data database regarding the processing and protection of personal data in personal data databases.<\/li>\n\n\n\n<li>Develop a procedure (procedure) for internal control over compliance with the requirements of Ukrainian legislation in the field of personal data protection and internal documents regulating the activities of the owner of the personal data database regarding the processing and protection of personal data in personal data databases, which, in particular, should include norms on the periodicity of such control.<\/li>\n\n\n\n<li>Inform the owner of the personal data database about violations by employees of the requirements of Ukrainian legislation in the field of personal data protection and internal documents regulating the activities of the owner of the personal data database regarding the processing and protection of personal data in personal data databases no later than one working day from the moment of detecting such violations.<\/li>\n\n\n\n<li>Ensure the storage of documents confirming the provision of consent by the data subject for the processing of their personal data and the notification of the data subject about their rights.<\/li>\n<\/ul>\n\n\n\n<p>7.4. To fulfill their duties, the responsible person has the right to:<\/p>\n\n\n\n<ul>\n<li>Receive the necessary documents, including orders and other administrative documents issued by the owner of the personal data database related to the processing of personal data.<\/li>\n\n\n\n<li>Make copies of the received documents, including copies of files of any records stored in local computer networks and standalone computer systems.<\/li>\n\n\n\n<li>Participate in discussions of the duties performed by them in organizing work related to the protection of personal data during their processing.<\/li>\n\n\n\n<li>Submit proposals for improving activities and enhancing work methods, make comments, and provide options for eliminating identified shortcomings in the process of personal data processing.<\/li>\n\n\n\n<li>Receive explanations on issues related to personal data processing.<\/li>\n\n\n\n<li>Sign and endorse documents within their competence.<\/li>\n<\/ul>\n\n\n\n<p>7.5. Employees who directly process and\/or have access to personal data in connection with their official (work) duties are obliged to comply with the requirements of Ukrainian legislation in the field of personal data protection and internal documents regarding the processing and protection of personal data in personal data databases.<\/p>\n\n\n\n<p>7.6. Employees who have access to personal data, including those who process them, are obliged not to disclose in any way personal data that have been entrusted to them or that have become known to them in connection with the performance of professional or official or job duties. This obligation applies after the termination of their activities related to personal data, except as provided by law.<\/p>\n\n\n\n<p>7.7. Persons who have access to personal data, including those who process them, in case of violation of the requirements of the Law of Ukraine &#8220;On Personal Data Protection&#8221;, are liable according to the legislation of Ukraine.<\/p>\n\n\n\n<p>7.8. Personal data must not be stored longer than necessary for the purpose for which such data are stored, but in any case, not longer than the period specified by the consent of the data subject for the processing of these data.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8. Rights of the Data Subject<\/strong><\/h3>\n\n\n\n<p>8.1. The data subject has the right to:<\/p>\n\n\n\n<ul>\n<li>Know the location of the personal data database that contains their personal data, its purpose and name, location and\/or place of residence (location) of the owner or manager of this database, or give an appropriate instruction for obtaining this information to authorized persons, except as established by law.<\/li>\n\n\n\n<li>Receive information about the conditions for granting access to personal data, in particular, information about third parties to whom their personal data contained in the relevant personal data database are transferred.<\/li>\n\n\n\n<li>Access their personal data contained in the relevant personal data database.<\/li>\n\n\n\n<li>Receive no later than thirty calendar days from the date of receipt of the request, except as provided by law, a response about whether their personal data are stored in the relevant personal data database, as well as receive the content of their personal data stored.<\/li>\n\n\n\n<li>Present a reasoned demand with an objection to the processing of their personal data by state authorities, local self-government bodies during the exercise of their powers provided by law.<\/li>\n\n\n\n<li>Present a reasoned demand for the change or destruction of their personal data by any owner and manager of this database if these data are processed illegally or are unreliable.<\/li>\n\n\n\n<li>Protect their personal data from illegal processing and accidental loss, destruction, damage in connection with intentional concealment, failure to provide or untimely provision, as well as protection from providing information that is unreliable or defames the honor, dignity, and business reputation of a natural person.<\/li>\n\n\n\n<li>Apply to state authorities, local self-government bodies, whose powers include the protection of personal data, regarding the protection of their rights related to personal data.<\/li>\n\n\n\n<li>Apply legal remedies in case of violation of legislation on the protection of personal data.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>9. Procedure for Handling Requests from the Data Subject<\/strong><\/h3>\n\n\n\n<p>9.1. The data subject has the right to receive any information about themselves from any subject of relations related to personal data without specifying the purpose of the request, except as established by law.<\/p>\n\n\n\n<p>9.2. The access of the data subject to data about themselves is free of charge.<\/p>\n\n\n\n<p>9.3. The data subject submits a request for access (hereinafter &#8211; the request) to personal data to the owner of the personal data database.<\/p>\n\n\n\n<p>9.4. The request specifies:<\/p>\n\n\n\n<ul>\n<li>Surname, first name, and patronymic, place of residence (location), and details of the document identifying the physical person of the data subject.<\/li>\n\n\n\n<li>Other information allowing identifying the physical person of the data subject.<\/li>\n\n\n\n<li>Information about the personal data database concerning which the request is submitted or information about the owner or manager of this personal data database.<\/li>\n\n\n\n<li>List of requested personal data.<\/li>\n<\/ul>\n\n\n\n<p>9.5. The period for reviewing the request for its satisfaction cannot exceed ten working days from the date of its receipt. Within this period, the owner of the personal data database informs the data subject that the request will be satisfied or the relevant personal data cannot be provided, indicating the basis determined by the relevant regulatory legal act.<\/p>\n\n\n\n<p>9.6.
